Brazil requests extradition of Federal Representative Carla Zambelli

She fled to Italy after being sentenced to 10 years in prison

Supreme Court Justice Alexandre de Moraes sent the request for the extradition of Federal Representative Carla Zambelli to the Brazilian government on Wednesday (Jun. 11). The document was addressed to the Minister of Justice and Public Security, Ricardo Lewandowski.

Last week, Moraes ordered her arrest. She fled to Italy to avoid serving a ten-year prison sentence for hacking into the National Council of Justice’s electronic system in 2023.

The document contains a copy of the decision convicting the congresswoman, the relevant articles of the Penal Code on which the conviction is based, and a summary to assist the Brazilian government in requesting extradition from Italy.

“Mrs. Carla Zambelli Salgado de Oliveira, in a free, conscious, and voluntary manner, commanded the invasion of institutional systems used by the Judiciary by planning, enlisting, and directing a person with the technical skills and means necessary to carry out the task, with the aim of tampering with information without the express or tacit authorization of those in authority,” the text states.

Moraes also outlined the guarantees Brazil will provide to Carla Zambelli if Italy approves her extradition.

The minister undertook to:

  • Not subject Zambelli to imprisonment or prosecution for any acts predating the extradition request;
  • Not impose a life sentence;
  • Not aggravate the sentence for political reasons; and
  • Not subject the federal representative to torture or to inhuman or degrading treatment.

On Saturday (7), Moraes ordered the immediate enforcement of Carla Zambelli’s sentence. The decision followed the First of the Court’s unanimous rejection of an appeal filed by the congresswoman’s defense seeking to overturn the conviction.

Hacker Walter Delgatti was also sentenced to 8 years and 3 months in prison in the same case. According to the investigation, the hacking was carried out by Delgatti at Zambelli’s behest.
